BELL PERKS CLUB TERMS AND CONDITIONS

CONDITIONS OF USE

Welcome to Bell Plumbing and Heating Website and Perks Club portal. By accessing, browsing, or shopping on this website, you agree to all the terms and conditions in this agreement. We reserve the right to make changes to our site, policies, service terms, and these Conditions of Use at any time and without notice to you. Please read them carefully. Please review our Privacy Notice, which also governs your use of the Site(s), to understand our practices.

BELL PERKS CLUB TERMS

• By signing up for our Perks Club, you agree to the Terms of Use and any subsequent changes to Terms.
• Initial enrollment in the Bell Perks Club will require payment up-front for a 12-month membership.
• Your Perks Club may be transferred should you move to another home within Bell’s service area. 
• Club memberships must be in good standing to enjoy benefits.
• The auto-renewal option at $99 requires a valid credit card to be on file.  If the customer is unwilling to allow a credit card to be stored, the $129 non-auto renewal membership will be the available option.
• Added coupons or discounts must be pre-approved.
• Bell cannot guarantee preventative care during peak heating and cooling season, typically between May 25th – Aug. 1st and Oct. 15th – Dec. 31st. 
• Bell employees will adhere to safety protocols and may refuse service in the event of unsafe or unhealthy conditions.
• Bell will no longer service evaporative coolers.
• If you decide not to take advantage of Perks Club benefits, memberships have no monetary value. 
• Club benefits are not for resale and are not redeemable for cash. Partial year use is not refundable.
• 20% discount applies to Service appointments and excludes our $89 Mainline Drain Clean special as well as installation projects.
• Extended Labor Warranty requires that Perks Club participation is uninterrupted, and paid regularly, during the entire warranty period.
• Warranty excludes compressors, heat exchangers, coils under manufacturer warranty only. Equipment must have been installed by Bell. This plan does not cover warranties provided by other companies. Warranty does not cover refrigerant leaks.
• Warranty will be made invalid if another company performs work on Bell installed equipment
• Equipment warranties require annual maintenance per manufacturer’s recommendations.
• Our Waived Service Evaluation Fee applies when work is completed during the same visit and applies only during regular service hours. Emergency after hours Evaluation Fees remain unchanged. If no service work is requested during the Technician visit, a Service Evaluation Fee will be collected.
• Perks Club members may apply paid membership fees toward the purchase of new heating and cooling equipment. 50% of paid fees may be applied to a single Furnace, Boiler, or Air Conditioner. 100% of paid fees may be applied to a combination Heating and Cooling unit installation. Equipment discounts require uninterrupted Perks Club membership.
• For purposes of discounts, Senior applies to persons 65 and older. Veteran applies to Active-Duty U.S. Military (Army, Navy, Air Force, Marines, National Guard, Coast Guard, Space Force, and Active Reserve) U.S. Military Veterans. U.S. Military Retirees. First Responder applies to Police Officer, Sheriff/Sheriff’s Deputy, Correctional Officer, State Trooper, Federal Law Enforcement Officer, Firefighter, EMT, Nurse, and Paramedic.
• Bell Plumbing and Heating reserves the right to modify these Terms and Conditions without prior notice.

ELECTRONIC COMMUNICATIONS

Visiting Bell’s website(s) constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email, and on the Site(s), satisfy any legal requirement that such communications be in writing.

USER CONDUCT

By using Bell’s website(s), you agree to comply will all applicable local rules regarding online conduct and agree that by or while accessing or using the Site(s), you agree that you are the sole authorized user of your account, you will use only your own information, and you are responsible for protecting your log-in credentials.

SITE ACCESS

You may use Bell’s website(s) and Membership Portal as intended and only as permitted by law. The licenses granted by Bell to use our site(s) terminate if you do not comply with these Conditions of Use or any other Terms. This license does not include any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Bell Plumbing and Heating, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities, and expenses relating to and or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party or your violation of any applicable laws, rules or regulations.

LIABILITY DISCLAIMER

The information, software, and services included in or available through this site may include inaccuracies or typographical errors. Changes are periodically made to the information herein. Bell Plumbing and Heating may make improvements and/or changes in the Site(s) at any time.
To the maximum extent permitted by applicable law, in no event shall Bell Plumbing and Heating and/or its agents be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever arising out of or in any way connected with the use or performance of the Site(s) or failure to provide services. The User’s sole remedy is to cease use of the Site(s) and receive a refund of Membership fees incurred.
